Civil Litigation

This is an area of the law that does not involve criminal proceedings. It is a legal procedure involving two or more parties to a court process. The standard of proof for a fact is based on balance of probability, a lesser standard of proof as compared to criminal proceedings, which require proof beyond reasonable doubt. Wills and Estates

Probate law regulates a person’s estate after they die. This Act is called the Wills and Succession Act (Alberta). This law deals with issues such as how to file probate applications in court, how to create a legally valid and binding will, how to amend a will, how to distribute an estate among beneficiaries, and what happens to an estate when someone dies without a will. It also covers what happens if the will is invalidated and what the impacts of other laws, such as the Dower Act and Income Tax Act, are on an estate. Child Welfare

The legislation regulating the protection of children through intervention services in Alberta is called the Child, Youth, and Family Enhancement Act. The focus of this law is to ensure that children are safe through intervention services with minimal disruption to the family unit. A child may require intervention services if the child is abandoned; lacks the necessaries of life; lacks adequate supervision; lacks protection from physical, psychological, or emotional harm; or if the child is at high risk of physical, psychological, or emotional harm. The Director has different methods of dealing with a child who needs intervention services: the Director may enter into a family enhancement agreement, custody agreement, or permanent guardianship agreement; may seek a supervision order or apprehension order for the removal of a child from a guardian; or may seek initial custody, a temporary guardianship order, or a permanent guardianship order.
